Pharmaceutical manufacturer Merck has filed a lawsuit against the Centers for Medicare and Medicaid Services (CMS) on the grounds that the drug “negotiation” provisions included in last year’s Inflation (Reduction) Act is unconstitutional. Merck argues that the move amounts to “political Kabuki theater,” where private companies have no alternative but to agree to prices. Companies that refuse to negotiate will face heavy taxes imposed by Democrats. Merck’s suit came in before the CMS is scheduled to release the names of the first tranche of drugs set in the process on 1 September. The case could lead to an eventual Supreme Court smackdown.

California Bill to Stop Employees From Confronting Shoplifters Goes to Assembly
A controversial bill has been passed by the California Senate prohibiting employers from requiring staff to intervene in active shoplifting. SB 553, authored by democratic Senator Dave Cortese, requires employers to do more to “keep employees safe at work,” by maintaining a violent incident log, providing active shooter and shoplifter training, and stop policy that require workers to confront suspected active shoplifters. The California Retailers Association (CRA) fears the new law could allow more people to steal from stores. The Target store at 1690 Folsom St recently experienced over 10 thefts a day and has limited some of its merchandise. The CalChamber called the bill a regulation that applies to all workplaces, not just retail, and employers are not well-equipped to prevent workplace violence.
