The National Popular Vote Idea Is Unconstitutional and Should Be Abandoned
Conservatives are concerned about the National Popular Vote (NPV) project, which seeks to elect the President through a national popular vote, bypassing the Electoral College. An agreement or “compact” among states is being sought, whereby all electoral votes of the participating states will be cast for the winner of the national popular vote. Dependent on getting an additional 65 electoral votes, the latest target of the NPV movement is Michigan. Conservative groups are warning about the project's nefarious implications. Even if it was adopted by enough states, it is difficult to believe it would pass constitutional muster.

This election system is flawed as it could potentially magnify difficulties for electing a President without controversy. Furthermore, under the NPV process, any citizen’s vote for an elector pledged to vote for their preferred candidate would be nullified if all the state’s electoral votes transferred to the winner of the national popular vote. If the NPV goes into effect, no voter would have an equal opportunity to elect a President with every other voter in the same state, because it nullifies the vote of every voter in a state that does not vote for the national winner. This undermines their privileges as US citizens and contravenes the 14th Amendment, in effect violating the rights of citizens to have their vote counted. In practice, the National Popular Vote idea is a state law that takes away every voter in that state’s right to have their vote counted toward the election of the President of the United States.
