A property owner in Virginia is suing the Virginia Department of Wildlife Resources (VDWR) and three conservation officers for entering his private 30-acre parcel without his consent and confiscating a game camera. Josh Highlander claims the officers entered his property without a warrant or his knowledge and also charged his brother for turkey hunting over bait. The Institute for Justice, a non-profit law firm representing Highlander, argues that the Open Fields Doctrine, which allows surveillance in privately-owned open fields, shouldn't apply under the Virginia constitution.
