The U.S. attorney’s office in Delaware declined comment, while the Justice Department spokesman said that Weiss had "full authority over this matter."

Eastman, amongst others, pointed to specific wording in the US Constitution that "Each State shall appoint" its electors "in such Manner as the Legislature thereof may direct". Disbarment would dissuade lawyers from advocating for their clients, fearing action for supporting novel legal theories due to client politics. The California Bar's prosecution of Eastman seems a political witch hunt as it tried to ridicule the independent state legislature theory on day one of the trial.
