The "death benefit" paid by Social Security is a $255 one-time payment to the spouse of someone who had worked and paid Social Security taxes, and was originally meant to reimburse family members with an amount equal to 3.5 percent of the money the deceased had paid to the system. Congress capped it in 1954 at $255 and restricted the payment only to a "spouse who was living with the deceased at the time of death" in 1983. It has been suggested to either raise the death benefit to something meaningful like $2,500 or eliminate it, but it remains a popular feature of the Social Security program.
The $255 death benefit is only paid on the account of someone who had worked and paid Social Security taxes. The expired individual's spousal benefits end once they die, meaning that the benefit rate will remain the same for the surviving spouse. The death benefit requires an application and is not automatic. Additionally, the law only allows for the death benefit to be paid to a widow who was living with the deceased at the time of death. It cannot be paid to divorced spouses.
