In November 2022, DePape pleaded not guilty to these charges and state charges of attempted murder, assault with a deadly weapon and elder abuse. The federal trial will begin on Wednesday, Oct. 11, prior to the state trial.

David DePape's attorney, Adam Lipson, stated in a state court appearance that he will not set a trial date until he has a better idea of when the federal trial will end. Surveillance and bodycam footage of the incident showed Paul Pelosi and DePape with hammers in their hands, leading to DePape swinging at Pelosi and injuring him. DePape has remained silent during the court appearances.
