Despite the greenback’s share of international reserves gradually declining, Yellen states that no legitimate alternatives in today’s global marketplace could displace the dollar and that no country is able to replicate the dollar’s role in the global financial system. Despite this, the dollar’s supremacy is expected to dissipate incrementally in the future. While de-dollarisation may be part of a decades-long trend, Goldman Sachs thinks the dollar king being dethroned is an “unlikely story.”

In addition to other currencies growing in reserve share, gold is beginning to threaten the dollar hegemony, with central banks bought just over 1,100 tons of the yellow metal in 2022, the largest net amount since 1950. Marshall Billingslea, a senior fellow at the Hudson Institute, suspects that if China does maintain larger gold reserves than what international estimates show, then “they could start issuing gold-denominated, gold-backed yuan contracts” furthering their ambition for introducing the yuan onto the world stage. The US Treasury Department is instructed to prepare for a potential scenario where China dumps its $859 billion of U.S. government bonds.

Federal courts would approve forfeitures, replacing the current conflict-of-interest-based system. The bill offers court-appointed counsel in civil forfeiture cases, and raises the burden of proof from "more likely than not" to "clear and convincing evidence," enhancing protections for innocent owners. However, seizures based on "probable cause" would still be legal.

In March 2021, the Institute for Justice filed a federal lawsuit on behalf of Linda Martin, whose $40,200 stored in a safe deposit box was seized by the FBI during a raid on US Private Vaults in 2019, without any evidence of her involvement in illegal activities. Martin's "petition for remission," filed to recover her property, admitted it was subject to forfeiture. Federal lawsuits like hers point to the fundamental injustice of the current civil asset forfeiture system that allows law enforcement agencies to confiscate assets without charging or convicting the owner, and without adequate checks and balances. The FAIR Act represents an important reform step in the right direction, but critics argue requiring a criminal conviction is the only way to stop forfeiture abuse.
