Why Trump's Espionage Act Indictment is A Manufactured Process Crime
The FBI raided Mar-a-Lago invoking the Espionage Act, leading to Donald Trump facing 37 charges related to handling classified documents, including violating the Espionage Act for "willful retention of national defense information." However, the indictment never mentions the Presidential Records Act (PRA), which recognizes a President's access to documents when they leave office. The case comes down to process crimes generated by the investigation, and without the investigation, there would be no basis for going past Comey's "reasonable prosecutor" standard.

Hillary Clinton was investigated under the Espionage Act but was not charged as the FBI stated there was no clear evidence they intended to violate the law. The different outcomes of the investigations led to different responses and charges. Process crimes generated by the investigation have been at the heart of the lawfare directed by the Obama and Biden Department of Justice against Trump and his allies. The investigation is therefore the crime, subtract the investigation, and there would be no basis for going past Comey's "reasonable prosecutor" standard.
