The EPA must make the case that these technologies are adequately demonstrated for the power sector. The new standard is faced with economic, technical, and legal challenges.
Regulated utility markets pass retrofit costs directly through to ratepayers, while in wholesale markets, thermal generators will not operate at losses if they do not clear their bids into the market. Evolution of markets is needed to compensate thermal facilities deemed critical to grid reliability. The IRA 45Q tax credits for CCUS projects bring new hope for fossil-fuel generators, however, the economic feasibility of CCUS for most gas and coal plants is not attractive, with the IRA 45Q credit currently not set to expire until 2033. The proposed guidelines may accelerate and de-risk supply investments for low-GHG hydrogen offtake, which would transform the low-GHG hydrogen market. Issues of legal challenges and opposition to Biden’s newly proposed standards are likely to occur.
