Alexandria Ocasio-Cortez said the Republicans were holding negotiations hostage and that the chaos of not coming to an agreement would be catastrophic.

If the tribunal were to decide that the college cannot prosecute people in breach of “recommendations,” this would invalidate all investigative orders written for other doctors currently being investigated or prosecuted around COVID-19, noted Alexander.

CPSO’s counsel argued that Luchkiw has breached the rules for professional conduct by refusing to cooperate with the investigation, as doctors are obliged to “cooperate fully with an investigator.” Luchkiw refused to cooperate, stating her view that the CPSO’s investigation orders lacked reference to actual events. Alexander contests CPSO’s argument that Luchkiw might have caused “harm” to her patients by not following COVID-19 health policies. Alexander has also argued that the CPSO’s guidelines violate the Charter rights to free speech and informed consent. If the tribunal decides against Luchkiw, it will allow CPSO to continue its investigation into her conduct, potentially impacting other doctors being investigated or prosecuted around COVID-19.
