The first Jan. 6 defendant sentenced for seditious conspiracy will be Oath Keepers founder Stewart Rhodes and members of his anti-government group. Prosecutors are seeking a 25-year jail term for Rhodes which would be the harshest sentence handed down in relation to the U.S. Capitol attack. This would set a standard for more punishments of far-right extremists to come. The Oath Keepers’ actions are considered as terrorism and ensuring that stiff punishments are put in place is crucial to sending a message to those who may instigate political violence in the future.

Prosecutors are seeking prison sentences ranging from 10 to 21 years for other Oath Keepers involved. Judges have so far rejected the Justice Department's request to apply a "terrorism enhancement" in cases, but they are urging the judge to apply it in Oath Keepers' case to influence the government through "intimidation or coercion”. The Justice Department considers this unique compared to any other defendant convicted of a role in the attack and are pushing for these members of the anti-government group to be sentenced to enhanced penalties for "terrorism". More than 1,000 people have been charged with federal crimes arising from the riot and more than 500 have been sentenced.
