First Citizens claims that HSBC illegally hired the ex-SVB staff and secured confidential, proprietary and trade secret information that provided an unfair competitive advantage, thereby short-circuiting an expensive process to launch its own practice. HSBC has yet to comment.
Red State: 9th Circuit Reverses Ruling That Criminalizing Illegal Immigrant Reentry Is Racist
The 9th Circuit Court of Appeals overturned a Nevada judge's decision that re-entry laws were racially motivated. If upheld, the ruling would prevent prosecution for illegal re-entry in 10 states under the 9th Circuit's jurisdiction. The Mexican citizen Gustavo Carrillo-Lopez was indicted for violating § 1326(a) through unauthorized re-entry into the US. Effective in 2021, the charges brought against Carrillo-Lopez were dismissed for violating the 5th Amendment, being racist in origin. However, the DOJ argued that 1952 Nationality Act remedied the problem and is constitutional. The 9th Circuit sided with the DOJ, concluding that there was no discriminatory animus against Hispanics.
