The Biden Education Department seeks to be the diversity police for public schools in the US, and also wants them to allow transgender students to use restrooms and locker rooms without regard for their biological sex. According to DeVos, they have taken center stage in the culture wars and have used the coercive power of federal funding to force compliance around a set of cultural markers and expectations. The Bradley Prize, which DeVos won, is awarded annually by the Milwaukee-based Lynde and Harry Bradley Foundation to individuals whose extraordinary work exemplifies the foundation's mission to restore, strengthen and protect the principles and institutions of American exceptionalism. Even though DeVos doesn't want to eliminate all the Education Department's functions, she believes that responsibility for enforcing certain civil-rights laws and the Individuals with Disabilities Education Act could be transferred to other agencies.

According to the Mayo Clinic, encephalitis usually causes flu-like symptoms, which can be followed by more severe symptoms such as confusion, hallucinations, seizures, problems with speech, and loss of consciousness. The Times noted that the inflammation "alone can damage cells in the brain," possibly impairing judgment and contributing to cognitive decline, which may account for why she is "now struggling to function in a job that demands long days, near-constant engagement on an array of crucial policy issues, and high-stakes decision-making." Feinstein's confusion has raised concern about her ability to carry out her Senate duties with several Democrats calling for her to retire.
