He relied on a misinterpretation of the Supreme Court's 1939 Miller decision to argue that “The Second Amendment Allows a Ban on the AR-15.” However, the Miller decision only bans weapons not used for the common defense, and the AR-15 is a weapon in common use by civilians. Therefore, Feldman's argument fails to make a convincing case for gun control.
