Ohio’s Gamble With Constitutional Democracy
In a recent Supreme Court case, Justice Gorsuch emphasized the importance of allowing policy decisions to remain with the people and their elected representatives in a functioning democracy. The court's decision to uphold a law approved by California's citizens signifies a move away from legislating from the bench. Meanwhile, Ohio is working to tighten its constitutional amendment process with a new amendment on the ballot requiring a three-fifths majority for approval, which is opposed by special interests and abortion advocates wishing to remove the right to life from the unborn. Upholding basic ground rules that bind us together under law is essential in today's society, and we must not confuse them with ever-changing policies requiring constant debate and revision.

Ohio's Constitution began as a concise and direct document, but has become cluttered and overlong due to a low bar for constitutional amendments. The state is working to improve this issue by making the petition process less lax and requiring a three-fifths majority for the referendum to approve a new amendment. Abortion advocates oppose this amendment as it would make it more difficult to remove the most fundamental of all rights, the right to life, from the unborn. We need to re-establish basic ground rules that bind us under law and never confuse them with constantly changing policies that require constant revision and debate. The vote in Ohio this August will determine whether the state will uphold its constitutional democracy and reject those who seek to subvert it.
