Kombucha is a fermented drink made from tea, sugar, bacteria, and yeast, with alcohol levels typically below 0.5%. Under current tax code, kombucha is subject to the same excise taxes as beverages with significantly higher alcohol content. The KOMBUCHA Act seeks to exempt kombucha with an ABV of less than 1.25% from these excise taxes. With the kombucha industry projected to have a $5.25 billion economic impact by 2025, the legislation aims to support small businesses and create more jobs.
