Feds Allege Tennessee Discriminates Against People With HIV Through ‘Aggravated Prostitution’ Law
The Justice Department alleges that a Tennessee law, which classifies misdemeanor prostitution crimes as felonies if the defendant has HIV, discriminates based on disability. They argue that the law violates the Americans with Disabilities Act by subjecting people with HIV to harsher penalties solely because of their HIV status. The state law imposes felony charges, potential prison sentences, fines, and registration as a sex offender on individuals with HIV who engage in sex work, regardless of the actual risk of harm or transmission.

On World AIDS Day, the Justice Department criticized Tennessee's law criminalizing HIV transmission. The law, enacted in 1991, has faced legal challenges for stigmatizing and discriminating against individuals. The ACLU and Transgender Law Center previously filed a federal lawsuit against the law. While the state removed a 30-year-old statute that required disclosure of HIV diagnosis before sex, laws criminalizing transmission still exist in 35 states. These laws, often outdated and based on limited knowledge about HIV, may discourage testing and increase stigma.
