A federal judge has just upheld Florida’s law protecting women’s sports from the transgender pretender crowd.
The challenge was based on the law violating Title IX, however the judge disagreed and dismissed the case:
Here’s more from Florida’s Voice:
A federal judge dismissed a legal challenge to Florida’s Fairness in Women’s Sports Act this week, noting that the 2021-signed law applies indiscriminately.
The lawsuit was filed on behalf of a teenage student athlete by her family, who attends public school in Broward County. The student identifies as a “girl,” but was born a “biological male,” the ruling said.
Judge Roy Altman approved Gov. Ron DeSantis’ motion to dismiss the legal challenge, which was predicated on arguing the law violates Title IX, deprives a student athlete of “equal protection,” and violates “due process right of privacy,” according to the ruling obtained by Florida’s Voice.
“We disagree that the statute comes anywhere close to creating the sort of caste-like system the Constitution forbids – a system in which transgender girls are legally demeaned and degraded because of their gender identity,” the ruling said.
The judge said in his ruling that Florida’s law applies regardless of transgender status or gender identity.
“The statute, after all, only applies [where] a biological boy (whether transgender or not) wants to play on the girls’ sports team of a public school,” the judge wrote.
“And, far from singling out transgender girls for special treatment, the law applies equally to the (almost) fifty percent of the population who are born as biological boys—and who don’t transition,” he continued.
“It, in fact, doesn’t have any effect on any other social, political, or commercial aspect of a transgender person’s life,” he wrote. “It simply provides that, consistent with the inherent biological differences between the sexes, biological boys (of whatever gender identity) cannot play on girls’ sports teams.”
As you might have guessed from the clear and common sense logic, Judge Roy Altman is a Trump appointee.
