


The DC Appeals Court just gave President Trump a big victory after a lower court Obama-appointed judge blocked Trump from nixing $16 billion in climate funds that Biden authorized.
The victory was 2-1, with both judges lifting the injunction being Trump-appointed.

Judge Rao also condemned the lower court judge in her opinion, writing:
We conclude the district court abused its discretion in issuing the injunction. The grantees are not likely to succeed on the merits because their claims are essentially contractual, and therefore jurisdiction lies exclusively in the Court of Federal Claims. And while the district court had jurisdiction to review the agency action, the grantees have not shown a likelihood of success on the merits.
I doubt the Supreme Court will take this up in the case of appeal, so this should be a permanent victory for Trump.
