


Judge Aileen Cannon just dismissed the classified document’s case being brought against President Trump by Joe Biden’s DOJ.
She dismissed it citing a violation of the appointments clause:
The New York Times reporter Maggie Haberman says “Hard to overstate how big a deal this is. This case was widely seen as the clearest-cut of the four.”
Jonathan Turley writes “The dismissal of the classified documents case is a seismic development. From the beginning of all of these cases, I have said that the Mar-a-Lago case was the greatest threat to the former president. It is now dismissed.”
I’m sure this will be appealed….or maybe it won’t after what happened this weekend? I would hope they’d just let the case stay dead but I doubt that’s going to happen.
UPDATE: Trey Gowdy predicts that what will happen is that this will be appealed to the 11th Circuit. Meanwhile the judge in DC in the J6 case against Trump will likely make a different determination about the appointments clause and that will be appealed to the DC appeals court. The different appellate courts will end up with a split decision that will have to be decided b the Supreme Court.
