NextImg:Trump Admin Puts UPenn on Notice for Violating Title IX By Allowing Men to Compete in Women’s Sports

The Trump administration is demanding that the University of Pennsylvania issue a statement indicating its athletic programs comply with Title IX, which the school violated by letting transgender-identifying men compete with women in intercollegiate sports.

The Department of Education’s Office for Civil Rights announced the move on Monday, giving UPenn ten days to resolve the Title IX violations. Otherwise, a referral seeking enforcement of the sex-discrimination law will be sent to the Department of Justice. The Trump administration concluded UPenn has been “denying women equal opportunities” and allowing male athletes to “occupy women-only intimate facilities.”

The Department of Education also demands that the university restore to female Division 1 swimming athletes the records and other recognitions that were stolen by men, who hold a clear biological advantage over women.

“Little girls who look up to Riley Gaines and Paula Scanlan can find hope in today’s action – the Trump Administration will not allow male athletes to invade female private spaces or compete in female categories,” said Craig Trainor, the Department of Education’s acting assistant secretary for civil rights.

Gaines and Scanlan both gained national attention for speaking out against Lia Thomas, the transgender-identifying swimming athlete who won the women’s 500-yard freestyle event at the 2022 NCAA women’s swimming championships.

Thomas also tied for fifth place with Gaines, who competed for the University of Kentucky, in the 200-yard freestyle race that season. Scanlan played for UPenn as a teammate of Thomas, whom Scanlan testified about before Congress in 2023.

“UPenn has a choice to make: do the right thing for its female students and come into full compliance with Title IX immediately or continue to advance an extremist political project that violates federal antidiscrimination law and puts UPenn’s federal funding at risk,” Trainor added.

The Trump administration suspended about $175 million in federal funding to UPenn last month over the university’s failure to heed President Donald Trump’s executive order that bans men from competing in girls’ and women’s sports. At the time, a university spokesperson claimed it was following policies set forth by the federal government, the NCAA, and the Ivy League.

UPenn did not respond to National Review’s request for comment about the Department of Education’s most recent announcement.

After Trump signed that executive order in February, the NCAA changed its transgender-participation policy to limit participation in women’s divisions to female athletes. The NCAA said it intended to comply with the order.

Shortly thereafter, the Department of Education asked the NCAA to “strip” various accolades from transgender-identifying men who defeated women in athletics. The department is now urging UPenn to do the same.

The university is also being pushed to send an apology letter to each female athlete who experienced sex discrimination while competing. The university would be required to meet the federal government’s demands under a proposed resolution agreement between both parties.
