


Ohio Northern University Law School professor Scott Gerber was fired from his tenured professorship several years ago. Why? The school resorted to legal smoke screens like lack of collegiality, but the obvious reason was that he opposed the school’s DEI agenda and said so. Gerber sued, and the case has been dragging on and on, but with trial scheduled later this year.
What is a vindictive university official to do? Why, counter-sue of course.
As we read in this FIRE release, ONU has now filed suit against Gerber for violating its rights — by suing to uphold his own. ONU’s case will go before a federal district judge (Gerber’s case is in state court), and the outcome probably depends on the politics of the judge. If it’s an Obama or Biden appointee, ONU might hang on; otherwise, the case should be dismissed with prejudice and costs against the university for wasting the court’s time.
This case is so revealing about the state of higher education in America. Dare to criticize the “progressive” policies that have taken hold, and you will be in the crosshairs of vicious administrators.
