


With the help of vague laws and zealous bureaucrats, the Biden administration has regularly abused federal regulatory power to help its friends and hurt its perceived enemies. In today’s Martin Center article, I write about the Grand Canyon University case. The Education Department has levied a record fine of more than $37 million against the school based only on its own “investigation.” It is hard to see the complaints as anything other than pretexts for the attack on a school that hews to traditional and Christian precepts.
When the Goldwater Institute made a Freedom of Information Act request for documents that could shed light on the motives for this, the Department refused to comply, so Goldwater is now suing.
The power of some unelected minions to act as judge, jury, and executioner was something the Founders had experienced under the British Crown, and they wrote the Constitution as they did to prevent this from happening in the United States. I point to Professor Philip Hamburger’s excellent book Is Administrative Law Unlawful? in concluding that we need to restore constitutional law.
