NextImg:Federal Grand Jury Indicts Democratic Congresswoman for ‘Forcibly Impeding’ Federal Law Enforcement

A federal grand jury is charging Democratic Representative LaMonica McIver (N.J.) on three counts related to interfering with and forcibly impeding federal law enforcement, New Jersey U.S. Attorney Alina Habba announced Tuesday.

“Today a federal grand jury seated in Newark, New Jersey returned a three-count indictment charging U.S. Representative LaMonica McIver with forcibly impeding and interfering with federal law enforcement officers,” Habba posted on X.

“This indictment has a maximum penalty of 8 years for Count One, an additional maximum penalty of 8 years for Count Two, and a maximum penalty of 1 year in prison for Count Three.”

The charges against McIver are tied to her involvement in a confrontation with law enforcement as she and two New Jersey Democratic colleagues attempted to inspect an Immigration and Customs Enforcement facility in Newark. Representatives Bonnie Watson Coleman and Robert Menendez Jr. joined protesters outside the ICE facility and scuffled with law enforcement as they attempted to conduct oversight.

“The facts of this case will prove I was simply doing my job and will expose these proceedings for what they are: a brazen attempt at political intimidation,” McIver said in a statement.

“This indictment is no more justified than the original charges, and is an effort by Trump’s administration to dodge accountability for the chaos ICE caused and scare me out of doing the work I was elected to do,” she added.

She said she will be pleading not guilty to the charges, potentially setting up a criminal trial in the not-too-distant future. Habba’s office previously charged McIver with assaulting, impeding, and interfering with law enforcement in violation of Title 18, United States Code, Section 111(a)(1).

McIver represents New Jersey’s 10th congressional district, a deep blue urban district that includes Newark and other municipalities. She won her seat following the death of Representative Donald Payne Jr. (D., N.J.) last year. It is unclear if the criminal proceedings will impact McIver’s political future.

Newark Mayor Ras Baraka (D), a state gubernatorial candidate, was arrested around the time of the scrum as he attempted to gain access to the ICE facility. Habba later dropped a trespassing charge against Baraka and he is now suing her for false arrest, malicious prosecution, and defamation.

Democrats have attempted to push back against the Trump administration’s mass deportation operation intended to remove more illegal immigrants than any other in American history. The deportations have focused on nabbing violent criminals and suspected gang members, and have included ICE raids in deep blue sanctuary cities.
