A New York City jury on Monday found <a href="/topics/daniel-penny/">Daniel Penny</a> not guilty in the last year’s chokehold death of Jordan Neely.

The verdict spared the former Marine from potential prison time after he subdued a homeless Neely when he boarded a subway train in May 2023 and began behaving erratically.

The verdict acquitted Mr. Penny, 26, on the remaining negligent homicide.

It came after the judge last week allowed prosecutors to drop the more serious manslaughter offense — which could have put Mr. <a href="/topics/daniel-penny/">Penny</a> behind bars for up to 15 years — after the jury said they were deadlocked on the charge.&lt;/&gt;
