NextImg:Nevada Supreme Court says ballots without postmark can be counted for three days after Election Day

The Nevada Supreme Court ruled Monday that mail-in ballots lacking a postmark can be counted up to three days following Election Day.

The state’s highest court affirmed a lower court’s dismissal of a challenge to the state law brought by the Republican National Committee and the Trump campaign.

The lower court had reasoned the RNC lacks standing, or sufficient legal injury to bring the lawsuit, which sought an injunction halting non-postmarked ballots from being counted past Election Day.



“If a voter properly and timely casts their vote by mailing their ballot before or on the day of the election, and through a post office omission the ballot is not postmarked, it would go against public policy to discount that properly cast vote,” the court’s order read.

Nevada allows all voters to vote by mail.

KTNV Las Vegas, an ABC affiliate, reported on Monday that Republicans were outpacing Democrats in early voting by more than 32,000 ballots.

Former President Donald Trump is up just 0.7% in the Real Clear Politics average of polls in the battleground state of Nevada against Vice President Kamala Harris, with one week until Election Day.

Nevada is worth six Electoral College votes.
