Homeland Security is evaluating whether it has the legal authority to deport students here on visas who praised Hamas and urged the eradication of Israel after the Oct. 7 sneak attack.

Sen. Josh Hawley, Missouri Republican, challenged Secretary Alejandro Mayorkas on the idea Tuesday, pointing to some of the despicable sentiments expressed at pro-Hamas rallies.

Mr. Mayorkas would not commit to the idea but said it is being studied.

“It is a matter of law and it requires a legal interpretation, and I am not in a position to provide that legal interpretation,” the secretary said.

“I think your answer is disappointing,” Mr. Hawley responded.

Senior former Homeland Security officials have said the department does have the authority — and even the duty — to oust foreigners who rallied in support of the attackers.

Emilio Gonzalez, former head of U.S. Citizenship and Immigration Services, said someone who endorses or espouses terrorist activity is supposed to be inadmissible.

He also said it violates the “good moral character” standard for immigrating to the U.S.
