Derrick Evans, who served a three-month prison sentence for participating in the Jan. 6 insurrection on the Capitol, is challenging Rep. Carol Miller (R-WV) for the Republican nomination in Tuesday’s West Virginia primary.

Evans served in the West Virginia statehouse for a little over a year, from Dec. 1, 2020, to Jan. 9, 2021, when he resigned after being arrested for his involvement with the insurrection.

He filmed himself inside the Capitol, saying, “We’re in, we’re in. Derrick Evans is in the Capitol!” He continued saying, “We’re in! Keep it moving, baby!” and, later, “Our house!”

Two days later, he was arrested and charged with two federal misdemeanors of unlawfully entering restricted grounds and violent entry and disorderly conduct. He pleaded guilty to the crimes in 2022 and served three months in a federal prison later that year.

Despite apologizing for his involvement in the attack, his campaign website calls him a “J6 prisoner running for U.S. Congress.” He maintains unfounded claims about the election, with his campaign website saying, “The 2020 election was stolen.”

His opponent, Miller, who has served three terms in Congress, also denied the results of the 2020 election. Miller was one of 126 lawmakers who filed an amicus brief in support of a lawsuit that would question the results of the 2020 election, in which no widespread voter fraud was found. She voted “no” to certify the election results in some states.

Evans is one of several people involved with the Jan. 6 insurrection who are running for office this year. More than 1,350 people have been charged with federal crimes for their involvement with the insurrection.
