


President Donald Trump said Sunday that U.S. military strength would be “instantly obliterated” without his tariffs, also claiming the nation would be “completely destroyed.”
A U.S. Court of Appeals for the Federal Circuit ruled 7-4 that the International Emergency Economic Powers Act does not grant the U.S. president the power to levy tariffs, ruling the tariffs Trump announced on multiple countries unlawful. The decision upheld the U.S. Court of International Trade’s ruling that the tariffs exceeded the president’s powers under IEEPA.

“Without Tariffs, and all of the TRILLIONS OF DOLLARS we have already taken in, our Country would be completely destroyed, and our military power would be instantly obliterated. In a 7 to 4 Opinion, a Radical Left group of judges didn’t care, but one Democrat, Obama appointed, actually voted to save our Country,” Trump wrote on Truth Social.
Trump didn’t specify who this judge is, but did express thanks “for his courage.” He also said this judge “loves and respects the U.S.A.”
Trump adviser Peter Navarro also expressed criticism of the court decision Sunday by “politicians in black robes.” However, Navarro said the “very strong” dissent in the decision provides a “road map” for how the Supreme Court can rule in the administration’s favor.
“But the questions are like, ‘Is there a national emergency?’ Of course. People are dying of fentanyl, and the trade deficit is absolutely devastating to this country. The tariffs, this is like a semantic issue, are tariffs qualifying as the regulation of imports? Of course they are. There’s plenty of law on that,” Navarro said on Fox News’s Sunday Morning Futures with Maria Bartiromo, guest-hosted by Jackie DeAngelis.

Navarro also noted “one of the red herrings” in the majority ruling, which claimed the tariffs were permanent. Navarro said neither Trump nor anyone in the Trump administration said the tariffs would stay forever, adding they would “go away” if China and drug cartels in Mexico and Canada “stop killing Americans.”
Trump said Friday he will use tariffs to benefit the United States “with the help of the United States Supreme Court.”
