NextImg:Trump's New York judge floats another gag order violation: 'I don't want anyone killed'

Donald Trump's New York civil trial judge dangled the threat of another gag order violation against the former president after a remark perceived as a threat against his court staff.

Trump was fined $5,000 last week for neglecting to remove an online post that was disparaging one of Judge Arthur Engoron's court staffers, which is in essence the only stipulation the limited gag order imposes. On Wednesday, Engoron said Trump's remarks outside the courtroom described his clerk as someone "very partisan sitting alongside him," according to a New York Daily News reporter in the room.

"This recent statement, assuming the Associated Press is correct, obviously was intentional," Engoron said. "The person sitting alongside me ... is my principal law clerk."

The clerk sitting next to Engoron was the same person Trump posted about online that resulted in his punishment last week, though defense attorney Chris Kise was quick to clarify that Trump's comment wasn't in reference to Engoron's staff.

Trump was quoted as stating: "If we had a jury, it would have been fair, at least, even if it was a somewhat negative jury, because no negative jury would vote against me. But this judge will because this judge is a very partisan judge, with a person who's very partisan sitting alongside of him, perhaps even much more partisan than he is."

Kise said Trump was referring to his former attorney Michael Cohen, who is testifying for his second day against the former president's business practices.

"That's exactly what he said," Kise said. "He's tired of listening to what he's hearing, and it's very hard."

Engoron said he took the matter "under advisement."

"I don't want anyone killed," Engoron said as Trump looked at the judge with a slightly tilted head.

The last time Engoron took a matter under advisement was on Oct. 20, and hours later, he hit Trump with a fine, warning that "more severe sanctions" would be applied if he committed another violation, whether intentional or unintentional, including possible imprisonment.

The judge's warning came after a morning of heavy cross-examination against Cohen by Trump attorney Alina Habba.
