NextImg:Trump files three motions to dismiss 2020 election case


Former President Donald Trump's lawyers have filed three new motions to dismiss the case surrounding his alleged attempts to overturn the results of the 2020 election.

The defense's arguments for dismissal are on constitutional grounds, on legal grounds, and on selective prosecution grounds, saying the indictment "rants endlessly about President Trump’s politics" and shows "a shockingly un-American display of authoritarianism..."

Trump also claimed that he should be granted absolute immunity in the federal election interference case against him. The prosecution, led by special counsel Jack Smith, rebuked that argument in a filing last week.

Jack Smith's team will also get a chance to respond to the newly filed motions within the next few weeks.

The 2024 GOP front-runner is arguing that the charges filed against him violate his constitutional right to appeal to the government and that there are no legal grounds for the case.

"Whatever one thinks of President Trump’s expressed opinions on this issue, his assertion of them does not constitute 'deceit' or 'trickery,'" the motions read, adding that the "claims alleged in the indictment all related to the most publicly visible, vigorously disputed, and widely reported debates of the day."

Trump also is lobbying for an investigation into "selective" prosecution because of President Joe Biden's relation to the case.

The Justice Department charged Trump this summer with four criminal counts related to his alleged attempts to subvert the 2020 election, which culminated with the Jan. 6 riot at the U.S. Capitol by a mob of his supporters.

The former president will stand trial in Washington on March 4, 2024, one day before Super Tuesday. He is also facing three other criminal cases. In Florida, he faces a federal indictment over his handling of classified documents. In Manhattan, he faces charges stemming from alleged hush money payments made during the 2016 election. And he will stand trial in Fulton County, Georgia, for efforts to overturn the 2020 election in the Peach State.
