NextImg:Trump drops appeal to move Manhattan hush money case to federal court


Former President Donald Trump dropped his bid to move his Manhattan hush money case to federal court in a filing on Tuesday.

The filing by Trump's attorneys to the 2nd U.S. Circuit Court of Appeals did not provide an explanation, but it does end the former president's attempt to appeal a prior federal court ruling, keeping the trial in state court.

The former president tried moving his case from state to federal court, but a judge ruled against him in July.

"Trump has failed to show that the conduct charged by the Indictment is for or relating to any act performed by or for the President under color of the official acts of a President. Trump also has failed to show that he has a colorable federal defense to the Indictment," Judge Alvin K. Hellerstein ruled in July.

Shortly after, Trump appealed the ruling, but he has now dropped the bid. Trump pleaded not guilty to the 34 criminal counts against him in a Manhattan courthouse earlier this year. The indictment followed an investigation by Manhattan District Attorney Alvin Bragg's office into alleged hush money payments Trump made to two women in 2016 ahead of the presidential election.

The trial is scheduled to begin on March 25, 2024, weeks after Trump's trial in federal court in Washington over alleged attempts to overturn the 2020 election is slated to begin.

The Manhattan indictment was the first of four criminal indictments levied against the former president this year. The subsequent ones were in federal court in Florida over alleged mishandling of classified documents, in federal court in Washington over the alleged election subversion, and in a Fulton County, Georgia, court over racketeering charges.
