


The Biden administration released a new Title IX regulation this week that would force federally funded schools to allow students to compete in sports programs and activities based on their “ gender identity .” The rule, which now enters a 30-day public comment period, is a direct response to legislation passed in several conservative states to protect women’s sports and private spaces and is a shameless attempt by the Biden administration to impose a radical ideology on a public that overwhelmingly opposes it.
Poll after poll shows the vast majority of people oppose allowing trans-identifying students to compete on women’s sports teams. President Joe Biden knows this, which is why he’s imposing this rule onto the public via executive fiat rather than trying to pass his own form of legislation.
THE FALSE MYTH OF TRANSGENDER OPPRESSIONMore insulting than this administration’s blatant disregard for women’s rights, however, is its attempt to gaslight the public on this subject. Education Secretary Miguel Cardona’s statement announcing the rule, for example, included this astonishing claim: "Today's proposed rule is designed to support Title IX's protection for equal athletics opportunity.” How, exactly, does allowing men with massive physical advantages to crush female competition advance “equal athletics opportunity”?
Ironically, the Biden administration’s rule change was announced the same day the Supreme Court punted on a case involving a West Virginia law that bans men and boys from girls' sports. The 4th Circuit Court of Appeals placed an injunction on the law, and the Supreme Court on Thursday declined to reverse that injunction.
Biden’s rule, however, makes it clear that the Supreme Court is going to need to weigh in on this matter — hopefully sooner rather than later. This Title IX regulation directly undermines state laws, such as West Virginia’s, restricting transgender participation in women’s sports and will inevitably be challenged as a result. Gov. Ron DeSantis (R-FL) has already vowed to take the administration to court if necessary.
There’s good reason to believe the bench will rule correctly when it does decide to take up the case. But until then, the public must endure Biden’s radical gender regime and its many consequences.
