NextImg:Ro Khanna encourages Biden to find Supreme Court student loan workaround


Rep. Ro Khanna (D-CA) said on Sunday that he supports President Joe Biden's efforts to find a way around the Supreme Court's decision to deem his student debt relief program as unconstitutional.

The high court ruled 6-3 on Friday in opposition to the president's plan, which would wipe away an estimated $400 billion in student debt by canceling $10,000 of federal student loans for borrowers making under $125,000 annually and $20,000 for Pell Grant recipients. Nebraska Attorney General Mike Hilgers sued the administration on behalf of his state over the program, with the backing of Missouri, Arkansas, Iowa, Kansas, and South Carolina.

"I am pleased that the White House is invoking the Higher Education Act," Khanna told ABC's This Week. "As you know, Justice Roberts explicitly said in the opinion that the opinion has no bearing on the Higher Education Act."

The Supreme Court decision comes as a nearly three-year moratorium on student loan payments will soon end. Interest will start accruing again on Sept. 1, with payments due beginning in October.

"I do hope that the White House will make sure that the interest doesn't accrue starting in September," he continued. "I know the president has said he isn't going to refer students to the credit agency. I also believe under the Higher Education Act, he can stop the interest accrual."

Democrats across the ideological spectrum slammed the Supreme Court's ruling and have vowed to continue action to deliver relief to Americans struggling to pay off student debt.

Sen. Bernie Sanders (I-VT), who chairs the Senate Health, Education, Labor, and Pensions Committee, said in a statement Friday that he was urging the Biden administration "to implement a Plan B immediately to cancel student debt for tens of millions of Americans who are struggling to pay the rent, put food on the table, and pay for the basic necessities of life."

Sanders said that Biden has "the clear authority" under the Higher Education Act of 1965 to cancel student debt.

"[Biden] must use this authority immediately," the leading progressive said. "As the Chairman of the Senate Committee on Health, Education, Labor, and Pensions, I will do everything I can to make sure that the more than 40 million Americans who are drowning in student debt get the relief that was promised to them as soon as possible."

Rep. Alexandria Ocasio-Cortez (D-NY) echoed Sanders's call, tweeting, "It is very important to note this SCOTUS ruling does NOT remove Biden’s ability to pursue student loan forgiveness. The Biden Admin can use the HEA (Higher Ed Act) — our position from the start — to continue loan forgiveness before payments resume. They should do so ASAP."
