Gov. Josh Shapiro (D-PA) has filed a criminal referral against Norfolk Southern following the train derailment that occurred earlier this month.

Shapiro announced on Tuesday that his office made a criminal referral to the acting attorney general in Pennsylvania for review. At the press conference in which Shapiro announced the filing, he claimed that the company gave incorrect information and was initially uncooperative following the large train derailment that spilled hazardous chemicals into East Palestine, Ohio.

"My administration will remain vigilant for any threats against Pennsylvanians, and we will hold accountable the company that made this vigilance necessary. The combination of Norfolk Southern's corporate greed, incompetence, and lack of care for our residents is unacceptable to me," said Shapiro.

He continued, "They chose not to participate in the unified command. They gave us inaccurate information and conflicting modeling data. And they refused to explore or articulate alternative courses of action when we were dealing with the derailment in the early days."

Democratic Gov. Josh Shapiro speaks after taking the oath of office to become Pennsylvania's 48th governor, Tuesday, Jan. 17, 2023, at the state Capitol in Harrisburg, Pa.

Shapiro did not specify what inaccurate information was given or what the conflicting modeling data was referring to. However, the revelation raises larger questions as to whether the company's alleged supply of incorrect information led to a delayed response, such as the controlled burning, and whether it means that the current situation is less safe than previously projected.

"In sum, Norfolk Southern injected unnecessary risk into this crisis, and they created confusion in this process. In the face of Norfolk Southern's arrogance and incompetence, I want you to know we are fighting back," Shapiro concluded.
