NextImg:North Carolina 12-week abortion ban upheld by federal judge


A federal judge in North Carolina on Friday upheld the majority of the state's 12-week abortion ban, allowing the law to take effect on Saturday, July 1.

The judicial approval comes shortly after Gov. Roy Cooper (D-NC) signed a new version of the bill that addresses some of the reasons why the court heard the case brought by Planned Parenthood South Atlantic and the American Civil Liberties Union, including language regarding the 10-week cutoff for medical abortions.

Cooper, who vetoed the original version of the bill but was overridden by the GOP-majority legislature, said the prior law "was so poorly written that it is causing real uncertainty for doctors and other health care providers."

Although he recognized the need to "clarify the rules and provide some certainty," he emphasized that his administration would "continue fighting on all fronts the Republican assault on women’s reproductive freedom.”

The court has temporarily enjoined the portion of the law requiring physicians to "document the existence of an intrauterine pregnancy before proceeding with a medical abortion." The injunction will expire on July 13, by which time the plaintiffs will need to provide further evidence to support a permanent blockage of the provision.

In addition to the abortion limitations, the bill also allocates funds for child care, parental leave, and community college assistance targeted toward supporting mothers and their families.

"Today's ruling is a crucial win for the unborn and their mothers," said Caitlin Connors, southern regional director for SBA Pro-Life America. "Passed with a supermajority of the legislature’s support, SB 20 reflects the will of the people of North Carolina. We celebrate that babies will be protected at 12 weeks gestation and the state’s record $160 million in funding for parental leave, material support, and many other resources will help women and children in North Carolina."

Planned Parenthood South Atlantic CEO Jenny Black called the abortion ban a set of "medically unnecessary restrictions" and stressed that the organization "remains committed to providing abortion care to as many people as possible within the unjust and inhumane confines" of the law.

“The court did the right thing in partially blocking this law," said Dr. Beverly A. Gray, one of the individual plaintiffs. "However, patients seeking care in North Carolina will still be forced to suffer the life-altering impacts of being denied access to essential health care because of an arbitrary ban on abortion after the 12th week of pregnancy. This suffering is inhumane and contradicts my duty to provide people with the necessary care they need.”

SBA Pro-Life America estimates that the 12-week abortion ban will prevent more than 3,000 abortions annually.
