An internship program from NASCAR has been criticized for seemingly discriminating against white people, with one college professor arguing that the program is illegal.

The program, titled NASCAR Diversity Internship Program, is a paid internship that gives college students mentorship in the racing industry. Applicants are required to meet multiple requirements, one of which is being a member of one or more ethnicities, with white or Caucasian absent from the list.

“Having a 100% quota for minorities for a position is illegal even under a very generous view of what is allowed,” David Bernstein, a law professor at George Mason University, said in an interview.

Bernstein added that this program is “blatantly illegal” and that it seems "to violate Title VII and the 1866 Civil Rights Act.” Title VII protects both employees and job applicants from discrimination "based on race, color, religion, sex and national origin" and also covers "the full spectrum of employment decisions," according to the Federal Trade Commission.

NASCAR is also offering a program titled "Drive for Diversity," which helps train "minority and female" recruits to either become a driver or a pit crew member. In the program's list of requirements, an applicant must be either a woman or a member of one or multiple "ethnic minority classifications."

The racing company is not the only company that has received pushback for creating programs that exclude white people, as retailer Best Buy was criticized for its professional development program intended for employees who "identify as Black, Latino, Hispanic, Asian or Pacific Islander." Though the program started in 2022, many social media users have called for a boycott of Best Buy.
