NextImg:Lawsuit filed for 5-year-old who wants to read book about gay penguins

A federal lawsuit has been filed on behalf of a handful of LGBT children who really want to read a book about gay penguins.

The lawsuit takes aim at Florida’s Parental Rights in Education law , which protects children from sexually inappropriate content through third grade. The law has since been extended to include K-12. But a group of litigants, which include a 5-year-old, are trying to stop the law. The lawsuit is against Florida officials and the School Board of Lake County, which decided to prevent children in kindergarten through third grade from checking out And Tango Makes Three in order to comply with state law. The lawsuit uses all the right buzzwords favored by leftists, including "misinformation" and "our democracy."

"Any attempt to diminish public education through misinformation and censorship directly threatens both our young people and the quality and competitiveness of our democracy," the lawsuit states. However, the lawsuit itself relies on a bending of the truth about two male penguins who "raised" a penguin.

"Tango tells the true story of two male penguins in New York City’s Central Park Zoo," according to the lawsuit. "The penguins, named Roy and Silo, formed an enduring pair bond and, with the help of a conscientious zookeeper, adopted, hatched, and raised a penguin chick named Tango." That summary is not entirely accurate, since the penguins were confused and tried to hatch a rock as if it was an egg.

Then a zookeeper snatched an egg from a heterosexual penguin couple and gave it to the two penguins, which helped make a political point about gay couples raising children. Silo also left Roy for a female penguin. It does not matter to the book’s authors, though. "We wrote the book to help parents teach children about same-sex parent families," co-authors Justin Richardson and Peter Parnell previously told the New York Times.

The lawsuit is similar to the story in that it uses half-truths and children to push a political agenda. One of the plaintiffs goes by "E.S." He "is a five-year-old boy in the custody and care of his legal guardian, Ann Roe."

He "wants to read Tango because of his interest in different family structures," but the kindergartner cannot because of the Florida law. Of course, that’s a stretch. The book is for sale for $9 on Amazon, and the library system for Mt. Dora, where the boy lives, also has several copies .

But reading the lawsuit, you would think Florida officials themselves are going home to home and ripping out copies of the book themselves. "Students’ access to books like Tango both preserves the right of Tango’s authors to speak and is essential to students’ active and effective participation in the United States’ pluralistic, diverse society," the lawsuit states.

The "Ban," capitalized in the lawsuit, infringes on the "Authors’ freedom of expression and the Student Plaintiffs’ right to receive information," according to the suit.

None of the plaintiffs are restricted from reading the book. Much like the debunked claim of widespread " book bans ," this lawsuit also is frivolous and only serves to push a political agenda. All of the plaintiffs can order the book cheaply online or even take it out of the local public library system.

Even if the libraries decided to remove the books, it would not prevent anyone from acquiring them. The decision to remove the book should stand because it protects parents who object to the teaching of sexual orientation in the classroom while not infringing on other parents who want to teach their children something else in their own homes.
