NextImg:Larry Elder to file FEC complaint Thursday, alleging RNC and Fox News could be fined up to $100 million

Republican presidential candidate Larry Elder announced on social media Wednesday night that he is filing a complaint with the Federal Election Commission against the Republican National Committee and Fox News Channel.

"I gave the RNC until 2 o'clock local time to put me on the debate stage. Otherwise, I'm filing a complaint with the Federal Election Commission," Elder said in a video while sitting in his hotel room in Milwaukee, Wisconsin.

The radio host explained that his election lawyer Craig Engle, who once served at the Federal Election Commission, has advised him that the RNC has not objectively applied the criteria required to be on the debate stage.

"I met all of their criteria," Elder asserted.

"40,000 individual donations. Three national polls showing me at 1% or better. They rejected one of the national polls," he added.

Elder said that the Rasmussen pollster that was rejected was alleged to be connected to former President Donald Trump, but he said even the poll company noted it has "nothing to do with Donald Trump."


"I have no idea why I am not on the debate stage," Elder said.

The Republican candidate called on the FEC to put fines of $100 million against the RNC and Fox News Channel.

"My lawyer argues that the equivalent is that the RNC is given an 'in-kind contribution' to the eight people who did make the debate to my detriment. That in-kind contribution could be valuable as a $100 million fine against the RNC and $100 million fine against Fox News," he argued.

The other Republican candidates who did not make the debate stage included businessman Perry Johnson, Miami Mayor Francis Suarez, Ryan Brinkley, and former Rep. Will Hurd. Hurd has decried the RNC's cherry-picking of polls that counted toward making the stage, and Johnson has hinted at a lawsuit.

RNC Chairwoman Ronna McDaniel is defending the party's requirements for the debate.

“Our rules were very clear. We put them out very early, and we abided by the rules,” McDaniel reportedly said in an interview. “There’s no favor, there’s no bias. We really just stuck to our rules.”

“I have nothing against all four of these candidates. They are far better than Joe Biden," she added. "I wish them the best. Their campaigns can continue. They still have time to qualify for California. But the rules are the rules.”

In his social media post, Elder wrote that his "complaint will be filed against the RNC with the Federal Elections Commission" on Thursday morning.
