The New York judge who presided over the Trump Organization criminal trial is in line to oversee the trial involving former President Donald Trump's hush money payment to porn star Stormy Daniels.

State Supreme Court Justice Juan Merchan will preside over the Trump case if the former president is indicted by a grand jury, per Fox News.

Merchan was the judge in the tax fraud case against the former chief financial officer for the Trump Organization, Allen Weisselberg, and in the case against the Trump Organization for similar charges.

Weisselberg pleaded guilty and was sentenced to five months in prison while also having to pay $2 million in taxes, penalties, and interest. The Trump Organization was found guilty of tax fraud and was fined $1.6 million, the maximum amount for the crime.

The Manhattan grand jury has not voted on whether to indict Trump but was expected to do so on Wednesday afternoon. A new report, however, says the grand jury may not vote on charges until Thursday or sometime next week.

Prosecutors in Manhattan have been investigating to see if Trump falsified business records by listing a $130,000 reimbursement of his then-lawyer Michael Cohen for paying off porn star Stormy Daniels to stay silent as a legal expense.

Falsifying business records in that way is a misdemeanor in New York, but it can be upgraded to a felony charge if the district attorney's office is able to successfully argue the falsification was done with the intent of concealing a second crime.

Reports initially began to swirl that Trump could be indicted in Manhattan on Saturday, with Trump posting on his social media platform Truth Social that he believed he would be arrested on Tuesday. The former president was not arrested Tuesday but could be arrested if he is indicted by the grand jury.
