NextImg:Judge extends order blocking Guard deployment to Portland

A federal judge extended the block on President Donald Trump‘s deployment of the National Guard to Portland on Wednesday, holding up the president’s bid to use troops in the city.

Judge Karin Immergut of the U.S. District Court for the District of Oregon extended her previous halt, which was scheduled to expire over the weekend, for an additional 14 days, meaning any federalized National Guardsmen are not allowed to deploy to the city in the interim.

Immergut is scheduled to hold a trial on Oct. 29 in the case brought by Oregon officials challenging Trump’s order to federalize Oregon National Guardsmen and deploy troops to the city. While Trump is not permitted to deploy any troops to the city due to Immergut’s extended order, a federal appeals court temporarily lifted her previous order to block the Oregon National Guard from being federalized.

A panel on the U.S. Court of Appeals for the Ninth Circuit held a hearing on the matter last week, with one judge saying it appeared there was no evidence Trump took any unlawful action with his Portland deployment plans. The appeals court has yet to issue a firm ruling regarding the appeal of Immergut’s order.

Her order extending the block of Trump’s deployment of troops to Portland is the latest setback in the legal battle Democrats are waging across the country over the president’s use of the National Guard to defend federal assets and personnel in Los Angeles, Portland, and Chicago.

In Los Angeles, a federal district judge initially blocked Trump’s federalization of California National Guardsmen before a federal appeals court panel lifted his order. U.S. District Judge Charles Breyer later ruled that Trump’s deployment of troops to Los Angeles violated a federal law barring troops from being used for regular law enforcement, which was also later blocked by a federal appeals court panel.

In Chicago, U.S. District Judge April Perry blocked the deployment of troops to Chicago following a hearing over a lawsuit brought by Illinois officials last week.

With the issue spanning multiple federal courts and appeals court circuits, Trump’s use of the National Guard in U.S. cities could make its way to the Supreme Court.
