


The deadline for U.S. Attorney for the District of Delaware David Weiss to turn over materials relating to his Hunter Biden investigation is swiftly approaching, giving him less than three hours to comply with demands from the House Judiciary Committee.
House Judiciary Committee Chairman Jim Jordan (R-OH) requested the materials last month as part of the committee's investigation into alleged improper retaliation against whistleblowers. The whistleblowers have claimed that the Hunter Biden investigation was "influenced by politics" and Weiss was "hamstrung" when making prosecutorial decisions — feeding into Republicans' cry of a two-tiered system of justice.

Jordan wrote to Weiss on June 22 asking him to provide information relating to the alleged retaliation, as well as a list of those who assisted him in responding to inquiries sent to Attorney General Merrick Garland. Weiss allegedly asked Garland to remove IRS whistleblower Gary Shapley and his team from overseeing the Hunter Biden investigation.
Jordan emphasized that the committee's requests "do not seek information that bears on the particulars or substance of an open criminal investigation."
"Instead, the Committee seeks information that bears on whistleblower retaliation to inform potential legislative reforms to protect Department whistleblowers — a matter that the Committee has also been examining with respect to the FBI," Jordan wrote.
However, in a June 30 response, Weiss said he was "not at liberty to provide the materials" as they were part of an ongoing investigation. He also claimed he had "ultimate authority" over the investigation.
"The whistleblowers' allegations relate to a criminal investigation that is now being prosecuted in the United States District Court for the District of Delaware," Weiss wrote. "At this juncture, I am required to protect confidential law enforcement information and deliberative communications related to the case. Thus, I will not provide specific information related to the Hunter Biden investigation at this time."
Jordan then gave Weiss a deadline of July 6 at 5 p.m. It is unclear what steps Jordan will take if Weiss misses the deadline.
