The House failed to override President Joe Biden‘s veto of legislation, allowing for the new joint-employer rule for the National Labor Relations Board to go into effect.

House members voted 214-191 to override the veto that would have blocked the Biden administration from significantly loosening the standards used for determining joint-employer status. However, because the measure needs two-thirds of the House to override a veto, it did not pass.

Those who were against Biden’s joint-employer rule said it would hurt small businesses and open them up to labor lawsuits while working to please “special interest” union groups.

Tuesday’s vote allows Biden’s 11th veto to stand, pushing him just ahead of former President Donald Trump, who had 10 presidential vetoes.

Biden said in a statement regarding the veto that the bill, authored by Rep. John James (R-MI), would allow companies to evade “their bargaining obligations or liability.”

“By hampering the NLRB’s efforts to promote the practice and procedure of collective bargaining, Republicans are siding with union-busting corporations over the needs of workers and their unions,” Biden wrote. “I am proud to be the most pro-union, pro-worker President in American history. I make no apologies for my Administration protecting the right to organize and bargain collectively.”
