


Two Republican members of the House of Representatives are demanding the Department of Education launch an investigation into a Wisconsin school district that allowed a male high school student to shower in the girl's locker room.
In a letter to Secretary Miguel Cardona, House Education and Workforce Committee Chairwoman Virginia Foxx (R-NC) and Rep. Mary Miller (R-IL) urged the department to launch a federal civil rights investigation under Title IX into Sun Prairie Area School District, citing an incident where a male high school student who identified as a girl used the shower in the girl's locker room and exposed his male genitalia to four freshman girls.

"We write to express our deep concern about recent reports that a Sun Prairie East High School (Sun Prairie, WI) male, claiming to be a female, showered and exposed himself to four freshmen women in a high school female locker room," the lawmakers wrote. "As set forth further below, we write to request the Office for Civil Rights open an investigation into the incident or conduct a compliance review of the Sun Prairie Area School District."
The letter says that the incident took place on March 3, and that the male student "announced he was transsexual and proceeded to undress and shower naked next to one of the young women." The female students, who had just participated in a swim class, were showering while wearing their bathing suits, and quickly left the locker room following the incident, according to the letter.
"We, and others on the Committee on Education and the Workforce, have repeatedly raised substantial concerns about the Department’s post-Bostock interpretation of Title IX," Foxx and Miller wrote. "We do so again with this letter. In short, the Department’s interpretation continues to endanger women by putting their rights and needs second to the political agenda of the Biden administration."

The Biden administration has sought to re-interpret Title IX in light of the Supreme Court's 2020 ruling in Bostock v. Clayton County, which said sexual orientation and gender identity are protected under Title VII of the Civil Rights Act, which prohibits discrimination on the basis of sex in employment. The Department of Education released proposed regulations in June 2022 that would interpret Title IX, which prohibits discrimination on the basis of sex in education, under the same criteria that Bostock applied to Title VII.
