A judge in Delaware sanctioned Fox News for not turning over evidence in a timely manner in the defamation lawsuit from Dominion Voting Systems.

Delaware Superior Court Judge Eric Davis appears likely to appoint a special master in the case after Dominion accused the news outlet of not handing over evidence for discovery, per NBC News.

Davis said in court on Wednesday he was considering appointing a special master to the actions of the legal team for Fox concerning evidence.

In the courtroom Wednesday, lawyers for Dominion reportedly played recordings of Fox News producer Abby Grossberg that were made in 2020 but were not properly handed over during the discovery period.

The sanction by the judge paves the way for Dominion to seek another deposition at the expense of Fox.

Rupert Murdoch is expected to take the stand in the trial as early as Monday, per a report from Bloomberg. He is expected to be the second witness called to the stand after opening statements on Monday.

The $1.6 billion defamation case filed by Dominion is against both Fox News and Fox Corporation for claims regarding voting machines during coverage of the 2020 election on the network. The lawsuit was originally filed by Dominion in March 2021.

The jury selection for the defamation case is scheduled to begin on Thursday, with the trial expected to begin on Monday.
