Former federal Judge J. Michael Luttig, who testified before the House Jan. 6 committee last summer, said former President Donald Trump is a greater threat to democracy than he was a year ago.
Luttig, a former judge on the U.S. 4th Circuit Court of Appeals, told CNN on Wednesday that Trump’s repeated claims about the 2020 presidential election results and the Justice Department’s treatment of him have hurt the country.

“For the 2 1/2 years since Jan. 6, these false claims have corrupted American democracy. They’ve corrupted American elections, and they’ve corrupted the perception of the American people in America herself,” he said.

During his testimony to the Jan. 6 committee, Luttig claimed Trump “instigated” a “war over our democracy” to remain president.
“This must come to a conclusion, and the trials of the former president now will become, together with the events of Jan. 6, the singular infamous events in American history,” he added in the interview.
A known conservative, Luttig commented on Trump’s latest indictment over election fraud claims and criticized the free speech defense the former president’s attorneys decided to employ against the DOJ’s newest charges.

“The indictment makes crystal clear that the former president is not being charged for his speech,” he said. “The evidence is overwhelming that the former president knew full well that he had lost the election.”
Trump faces two other criminal investigations, one over alleged mishandling of classified documents and the other a New York case related to hush money payments made to Stormy Daniels in 2016. The former president will likely get a fourth indictment from Fulton County, Georgia, as it is expected those charges will drop this month.
