NextImg:Fani Willis ordered to turn over messages with Jack Smith and Jan. 6 committee - Washington Examiner

Fulton County District Attorney Fani Willis was ordered to turn over all communication with special counsel Jack Smith and the now disbanded House Jan. 6 committee to the conservative watchdog group, Judicial Watch.

On Tuesday, Willis lost a case against Judicial Watch after the group brought a lawsuit against her office in March after it said it did not have any communication with Smith’s office or the Jan. 6 committee. Two months later, the conservative group asked the court to declare a default judgment, noting that Willis was served with the lawsuit in March 2024 and had “not filed an answer,” which “was due 30 days after service.”

Fulton County Judge Robert McBurney said that because Willis did not provide a timely response to the court, she would have to hand over records of all communications with Smith and the Jan. 6 committee to the conservative group in the next five days.

While Willis had said she was not properly served, McBurney said despite the initial confusion on the court docket, the prosecutor “never offered up a meritorious defense.”

McBurney additionally ruled that Willis violated Georgia’s Open Records Act by failing to respond to the lawsuit. He also ordered Willis to pay the legal fees of Judicial Watch’s attorneys. 

Her claims with Judicial Watch were similar to those with the House Judiciary Committee when she said she did not have responsive records to the request.

The lawsuit from Judicial Watch picks up some of the work of the House Judiciary Committee, in which both Willis and Smith were sent letters demanding they turn over all records of their cases against President-elect Donald Trump and if they had communicated with one another about the cases.

Willis denied any coordination with Smith. Smith brought forth a federal case against Trump for his efforts to overturn the results of the 2020 election and subsequent Jan. 6 mob at the Capitol. Since the election, Smith has dismissed the charges to avoid interfering with the long-standing tradition of investigating a sitting president. Willis brought forth charges of racketeering related to his efforts to overturn his narrow loss in Georgia.

Willis accused Rep. Jim Jordan (R-OH), judiciary committee chairman, of improperly interfering with her prosecution of Trump.

“Your attempt to invoke congressional authority to intrude upon and interfere with an active criminal case in Georgia is flagrantly at odds with the Constitution,” Willis wrote to him last year.
