NextImg:Donald Trump indictment: Judge orders hearing on Meadows request to move case to federal court

A federal judge has ordered an evidentiary hearing for Mark Meadows's request to move the Fulton County, Georgia, case brought against him to federal court.

Judge Steve C. Jones ruled on Wednesday that a hearing on the matter would be held on Aug. 28, the same day former President Donald Trump's lawyers will appear in court in Washington, D.C., for a different criminal case.

Meadows is ordered to serve Fulton County District Attorney Fani Willis with a copy of the notice of removal and a copy of Wednesday's order no later than Aug. 23.

"The Court concludes the face of the Notice of Removal ... and attached Indictment ... do not clearly indicate that summary remand of this matter is required. No opinion about whether the removal will be permitted or on a federal immunity defense is being made at this time," Jones wrote.

A remand is when higher courts send cases back to the lower courts for further review.

Meadows, Trump's former chief of staff, filed a motion on Tuesday to move the recent indictment against him to federal court. His legal counsel argued that because the case relates to conduct that occurred during his time as chief of staff, he has the right to remove his portion of the indictment from the Fulton County Superior Court.

According to the 41-count indictment, Meadows met with Georgia Secretary of State Brad Raffensperger's chief investigator, Frances Watson, in Cobb County to discuss an ongoing audit of signature matches. Meadows was charged under the state’s Racketeer Influenced and Corrupt Organizations Act.

Other notable names charged alongside Meadows and Trump are attorneys John Eastman and Rudy Giuliani. Trump was charged with 13 counts, including violating the RICO Act. The indictment accuses the defendants of unlawfully conspiring to conduct and participate in a "criminal enterprise" following Trump's 2020 election loss in Georgia.
