Former federal prosecutor Andrew Weissmann said it was “game over” for former President Donald Trump after audio was released Monday night of him discussing a “highly confidential” document with staffers.

Weissmann, previously one of special counsel Robert Mueller's top deputies in the investigation into Russian interference in the 2016 presidential election, told MSNBC’s Lawrence O’Donnell that this case is not about the facts since the “tape recording is absolutely clear.”

Weissmann added that this is now a matter of whether or not the government will start a trial before the general election and if the jury will “follow the law and the facts.” He also questioned if voters of the country will be concerned.

“He's not even charged with dissemination, that is, showing it to somebody,” Weissmann said, referring to Trump not currently being charged with dissemination of national defense information. “But even that could be proved.”

On Monday, CNN released audio of a meeting that took place in Bedminster, New Jersey, in 2021, capturing Trump discussing classified documents that he had taken with him after leaving the presidential office.

The audio is one piece of evidence that will be used in Trump's 37-count indictment of mishandling classified documents found at his Florida estate, to which the former president pleaded not guilty to in federal court in Miami earlier this month.

Weissmann said “there are many avenues for admissibility” regarding the audio, and “any responsible judge is gonna let this in.”

The audio is likely to be featured as evidence in Trump’s trial, Weissmann said, clarifying that even if prosecutors are unable to track the chain of custody for this specific top-secret document, the audio could still be used in the case as “it would be enough to show his state of mind.”

Weissmann emphasized the serious nature of this case and argued why the Department of Justice brought the charges forward, saying the “idea that a former president would act this irresponsibly with the lives of men and women in the intelligence community” while discussing national security is enough evidence.
