NextImg:Donald Trump arrest: Former president not due in court until December

Former President Donald Trump will not appear in court in New York until December, and a judge has warned him to refrain from using rhetoric that could spark civil unrest.

Judge Juan Merchan ruled that the former president will not stand in court again until the end of the year. An exact date is not yet known. Trump's lawyers asked for him to be excused from attending the hearing in person over security precautions.

There is no gag order in place, but Merchan asked both sides to refrain from comments that could inspire unrest or violence leading up to the former president's second appearance.

Trump was indicted on 34 felony charges of falsifying business records in the first degree, according to unsealed court records released Tuesday after Merchan announced the charges during the historic arraignment of the former president.

Trump is the first former president to be criminally charged in U.S. history. Trump pleaded not guilty to all 34 counts.

The indictment came out of Manhattan District Attorney Alvin Bragg's office. The grand jury investigating the former president heard from Trump's former lawyer, Michael Cohen, earlier in March.

Cohen testified that he made a $130,000 payment to Stormy Daniels during the 2016 campaign, and Trump allegedly made 34 false entries in his New York business records to conceal the payment, according to the indictment.
